Separate EPA programs and responsibilities
Learning objective: Identify the EPA program, responsible parties and separate worker requirements.
EPA asbestos requirements serve several purposes. NESHAP regulates emissions from covered sources, including facility demolition and renovation. AHERA addresses asbestos-containing building material in covered elementary and secondary schools. Accreditation provisions apply to specified asbestos activities and professional roles.
OSHA separately protects workers. A project may need both OSHA and EPA compliance, plus state, Tribal or local requirements. A contractor’s agreement does not automatically remove an owner’s or local education agency’s legal responsibilities.
This track focuses on existing buildings, schools, demolition, renovation and associated waste. It is not a complete course on asbestos manufacture, import, product restrictions, drinking water, mine operations or disposal-site operation. Determine those separate requirements when relevant.
The course awards no EPA accreditation, state asbestos license or abatement qualification. Use qualified professionals and the actual responsible agency to determine project requirements. Keep written evidence of the decision before disturbance begins.
